Nividas AB in bankruptcy – Information for customers

Nividas AB has been declared bankrupt as of 19 April 2023. Clearance sales in the company’s stores in Stockholm, Malmö and Gothenburg are now being carried out under the administration of the bankruptcy estate.

Below are answers to some frequently asked questions.

Returns

No returns are accepted for goods purchased in stores. No returns are accepted for products purchased online either. Customers who have ordered goods online have a theoretical right under the Distance Contracts Act to withdraw from the agreement (right of withdrawal) within two weeks, but due to the bankruptcy no payment can be made to the customer; instead, the customer will have a claim in the bankruptcy. Thus, as a rule, it is only to the customer’s detriment to cancel a purchase made before the bankruptcy after the bankruptcy has commenced.

Complaints

The bankrupt company is no longer able to accept complaints. Customers who wish to make a complaint about an item must instead submit a claim for compensation in the bankruptcy in accordance with the instructions in the section “Submitting a claim for compensation in the bankruptcy” below.

If you paid for the purchase by credit card, in some cases you may be able to make a claim for compensation directly against the credit card issuer for a refund in the event of non-delivery or a defect in the goods. In that case, contact your credit provider directly.

Open purchase and exchanges

Due to the bankruptcy, no open-purchase terms apply. You therefore cannot return an item on that basis. Nor can any right of exchange, regardless of reason, be accepted.

Gift cards and credit balances

Due to the bankruptcy, gift cards purchased before the bankruptcy cannot be used as a means of payment. Other credit balances cannot be used as a means of payment either.

Claims for compensation due to the gift card/credit balance not being usable may be submitted to the bankruptcy administration in accordance with the instructions in the section “Submitting a claim for compensation in the bankruptcy” below.

Advance payments and orders before the bankruptcy

Due to the bankruptcy, the bankruptcy estate may not make any refunds of advance payments made for orders of prescription glasses and sunglasses.

In cases where orders were available for collection in store at the time of the bankruptcy or arrived at the stores shortly thereafter, the customer concerned has been notified and given the opportunity to collect their order. At present, the bankruptcy estate has no possibility of completing those orders that were not ready and delivered from the company’s lens supplier as of the bankruptcy date.

All customers who have made payments in advance have a claim in the bankruptcy and are urged to follow the instructions in the section “Submitting a claim for compensation in the bankruptcy” below.

Submitting a claim for compensation in the bankruptcy

Submit your claim for compensation by emailing [email protected] . The claim must include the following information: (state the following in the subject line: NIVIDAS CLAIM)

  • Full name and postal address.
  • The amount for which compensation is being claimed.
  • Supporting documentation for the claim (e.g. receipt, copy or photo of gift card/credit note, etc.).

Remember to keep all receipts and other documentation (order confirmation, delivery notes, etc.) in support of your claim for compensation.

All claims submitted in the bankruptcy will be compiled in a statement of affairs, which will be submitted to the district court that decided to declare the company bankrupt.

Claims from consumers constitute so-called unsecured claims in the bankruptcy. If a distribution becomes relevant to unsecured creditors, including consumers, the bankruptcy administration will request that the district court decide to initiate a claims verification procedure. In such cases, you will be contacted directly by the district court with more information and a request to lodge your claim in the bankruptcy.

Please note that it may take between 6–12 months before the bankruptcy administration can provide any indication as to whether a distribution to unsecured creditors is likely.
